§ 54.01 PURPOSE.
(A) In adopting this chapter, the City Council finds that the discharge of water from any roof, surface, ground, sump pump or other natural precipitation into the city sewage system will, and has on numerous occasions in the past, flooded and overloaded the sewage system to such an extent as to cause significant and grave damage to the property of large numbers of city residents.
(B) This damage is caused by the backup of sewage into the living quarters of residents and in addition to other damage, creates a hazard to health.
(C) The City Council therefore finds it essential to the maintenance of health and to minimize damage to property that the provisions of this chapter be strictly enforced to avoid emergencies in the future.

§ 54.02 PROHIBITED WATER.
(A) It shall be unlawful for any owner, occupant or user of any premises to direct into or allow any storm water, surface water, ground water, well water, water from industrial or commercial air conditioning systems, roof water, water from field tile, or water from other natural precipitation to drain into the sanitary sewer system of the City of Madelia.
(B) No rain spout or other form of surface drainage and no foundation drainage or sump pump shall be connected or discharged into any sanitary sewer.

§ 54.03 SUMP PUMP AND RIGID PIPE REQUIRED.
(A) New subdivisions; all construction.
(1) A sump pump and rigid pipe discharge connection to the outside shall be required for all construction in new subdivisions when it is determined necessary by the W.W. Director to protect sanitary sewer infiltration.
(2) The W.W. Director shall conduct his or her analysis and make his or her determination of soil conditions on a subdivision basis.
(3) The sump pump and pipe discharge requirement will apply to all units constructed within a specific subdivision.
(B) Existing subdivisions; new construction.
(1) Any new construction in a subdivision platted prior to the effective date of this chapter shall be examined by the City W.W. Director when the footing inspection is made.
(2) At that time, the City W.W. Director will determine, based upon excavated soils, whether the sump pump and rigid connection are required.
(3) Should the building owner choose the option of installing a sump pump and rigid connection where they are not required, they shall be installed in accordance with § 54.04(A) and (B) below.
(C) Existing subdivisions; existing construction.
(1) Any existing construction in a subdivision platted prior to the effective date of this chapter in which a sump and pump have been or will be installed shall be required to install a rigid pipe connection discharge in accordance with § 54.04(B) below.
(2) It shall be unlawful to maintain any connection with the sanitary sewer carrying roof water, ground water, surface water or any other natural precipitation after September 13, 1993.
(D) Exceptions.
(1) In certain locations where surface storm water discharge would create a safety hazard during freezing weather, connection to the sanitary sewer may be maintained from October 15 to March 15.
(2) In no case shall any connection to the sanitary sewer be maintained from March 15 to October 15.
(3) Exceptions will be granted by permit on a case by case basis as determined by the City Engineer.

§ 54.04 SUMP, PUMP AND RIGID PIPE; METHOD OF INSTALLATION.
(A) The building shall have a drain tile placed around the inside or outside perimeter of the foundation connected to a sump pit. All baseboard seepage collection systems shall be discharged to the sump pit. The sump pit shall be located at least ten feet away from the inside sanitary floor drain.
(B) A discharge pipe shall be installed to the outside wall of the building with rigid pipe (plastic, copper, galvanized or black pipe) one-inch inside diameter minimum. The discharge pipe must have a check valve within one foot of the floor grade and union or other approved coupling for easy disconnection for repair or replacement. The discharge shall extend at least three feet outside the foundation wall.
(C) Alternate methods of installation:
(1) The discharge pipe may be connected directly to the municipal underground storm sewer system provided the discharge is at a higher elevation than the normal flow level and that an approved backflow prevention device is installed. A building permit shall be required for the construction of a discharge pipe which is connected directly to the municipal underground storm sewer system; and
(2) The discharge may be connected directly to the municipal curb and gutter system provided the pipe is placed under the sidewalk or boulevard and through the back of the curb and that an approved backflow prevention device is installed.

§ 54.05 POWERS AND AUTHORITY OF INSPECTIONS.
(A) Any person or individual served by city utilities by virtue of accepting the city utility service shall be deemed to have given his or her implied consent to an inspection by the city of the premises for compliance with this section.
(B) A refusal to allow the inspection shall be cause for discontinuance of all city utilities in accordance with such provision of the City Code.
(C) The city engineer and other duly authorized employees of the city bearing proper credentials and identification shall be permitted to enter all properties for the purpose of inspection, observation, measurement, sampling and testing pertinent to discharge to the community system in accordance with the provisions of the ordinance.
