§ 52.01  WATER RATES.

     The water rates for consumers of city water shall be as follows:

     (A)     Rates per month, per 1,000 gallons used by residential consumer and government agencies change by ordinance or resolution from time to time. These rates shall be updated annually, and shall be available for review at the Water and Wastewater Department, and also in City Hall.

     (B)     Rates per month per 1,000 gallons used by multi-living units connected to the same water meter change by ordinance or resolution from time to time. These rates shall be updated annually, and shall be available for review at the Water and Wastewater Department, and also in City Hall.

     (C)     Rates per month per 1,000 gallon used by commercial customers change by ordinance or resolution from time to time. These rates shall be updated annually, and shall be available for review at the Water and Wastewater Department, and also in City Hall.

     (D)     Rates per month per 1,000 gallons used by industrial customers change by ordinance or resolution from time to time. These rates shall be updated annually, and shall be available for review at the Water and Wastewater Department, and also in City Hall.

     (E)     Rates per month per 1,000 gallons used by large industrial customers change by ordinance or resolution from time to time. These rates shall be updated annually, and shall be available for review at the Water and Wastewater Department, and also in City Hall

     (F)     Irrigation/sprinkler rate per month per 1,000 gallons of water used change by ordinance or resolution from time to time. These rates shall be updated annually, and shall be available for review at the Water and Wastewater Department, and also in City Hall.

§ 52.02  PAYMENT OF BILLS.

     (A)     Bills for water shall be sent by the city to consumers on a monthly basis and shall be calculated monthly.

     (B)     (1)     All bills for water shall be paid to the City of Madelia on or before the eighteenth day of the month following the issuance of the bill by the City of Madelia. To any water bill not paid in full on or before the eighteenth day of the month following the issuance of the bill by the City of Madelia shall be added a penalty of 10% of the current portion of the bill.

          (2)     Any water utility more than 60 days past due or over the amount of $100 in unpaid billing will be shut off and will remain shut off until such time as the billing is paid in full. A reconnection fee of $50 will be charged when water service is restored. Any past due account which has made payment arrangements and is making payments as agreed will not be disconnected.

          (3)     Nothing in this provision shall preclude the City of Madelia from filing a special assessment lien for unpaid water utilities as allowed by Minnesota Statute.

     (C)     All consumers of water within the city who occupy real estate under a rental agreement of any nature shall deposit the sum of $50 with the W.W. Director at the time that the service is connected for the consumer. In the event that the consumer does not pay a water bill, the sum of $50 shall be applied toward the payment of the bill. When the consumer notifies the City of Madelia of his or her intention to vacate the premises, the City of Madelia shall, if the consumer's bill is paid in full,  has been kept current for 12 consecutive months, the deposit will be returned with interest determined annually.

     (D)     All industrial, commercial or institutional consumers of water within the City of Madelia shall, upon request by the City Administrator, deposit a sum equivalent to a one-month water usage bill, either actual or estimated.

     (E)     The City Administrator may cut off the city water from any consumer who fails to pay a bill for water on or before the eighteenth day of the month following issuance of the bill by the City of Madelia and shall cut off the water from any consumer who fails to pay the bill for water on or before the last day of the third month following the issuance of the bill by the City of Madelia unless the City Administrator is advised to the contrary by the Madelia City Council.

     (F)     Each charge levied by and pursuant to this chapter is hereby made a lien against the corresponding lot, land or premises served by connection to the water system of the city and all the charges which are on September 30 of each year more than 30 days past due, and having been properly billed to the occupant of the premises served, shall be certified by the City Administrator to the County Auditor between October 1 and 10 of each year. The City Administrator in so certifying the charges to the County Auditor shall specify the amount thereof, the description of the premises served, and the name of the owner thereof and the amount so certified shall be extended by the Auditor on the tax rolls against the premises in the same manner as other taxes, and collected by the County Treasurer and paid to the City Treasurer along with other taxes. Any charges levied by and pursuant to this ordinance and which have been properly billed to the occupant of any premises and not paid may be recovered in any civil action by the city in any court of competent jurisdiction.
